These Legal Notices, Website Terms of Use and Privacy Policy apply to https://cherrycreekresidences.com (the “Site”), which provides information concerning CHERRY CREEK, A FOUR SEASONS PRIVATE RESIDENCE, located at 215 Detroit St, Denver, CO 80206 (the “Project”).

The Project ownership entity is 215 Detroit Street Cherry Creek Property LLC, referred to in the Project marketing and sales disclaimers below as the “Developer.” The development company is Wexford Real Estate, Stillwater, and Zabel Development Company LLC, a Delaware limited liability company (the “Company”). References to “we,” “us” and “our” in the Website Terms of Use and Privacy Policy refer to the Company. The Company and Developer are separate legal entities. These website terms do not amend any executed purchase agreement or change the obligations of the parties to that agreement.
Four Seasons Private Residences are not owned, developed or sold by Four Seasons Hotels Limited or its affiliates (Four Seasons). The developer uses the Four Seasons trademarks and tradenames under a license from Four Seasons Hotels Limited, Four Seasons Hotels and Resorts Asia Pacific Pte Ltd., or Four Seasons Hotels and Resorts B.V.

THE PROJECT IS NOT REGISTERED FOR OFFER OR SALE IN THE STATE OF NEW YORK. NOTHING CONTAINED IN THIS SITE IS INTENDED OR SHALL BE DEEMED TO BE AN OFFER TO SELL REAL ESTATE OR REAL ESTATE SECURITIES IN THE STATE OF NEW YORK OR TO RESIDENTS OF THE STATE OF NEW YORK. None of Wexford Real Estate Investors, Stillwater Capital, Zabel Investment or Brue Baukol (each a “Named Party”) is the Developer identified in these Project marketing and sales disclaimers. Any and all statements, disclosures and representations concerning the marketing, development or sale of units in the Project shall be deemed made by Developer and not by any Named Party. To the extent permitted by applicable law, any purchaser agrees to look solely to Developer, and not to any Named Party or its affiliates or principals, with respect to those matters. Nothing in this paragraph eliminates rights that cannot lawfully be waived or changes the obligations of a party under an executed agreement.
The Site is intended to provide an overview of the Project. Information on the Site should not be relied upon as financial, tax, accounting, investment, business or legal advice. Prospective purchasers should consult their own qualified advisers and review the applicable offering documents and purchase agreement.

The sketches, renderings, graphic materials, plans, specifications, terms, conditions and statements presented on the Site are proposed only. Developer reserves the right to modify, revise or withdraw them, subject to applicable law and any executed purchase agreement. Improvements, designs and construction are subject to obtaining the appropriate federal, state and local permits and approvals.

Drawings, artist renderings and other depictions are conceptual and provided for reference and illustration only. They should not be relied upon as representations, express or implied, of the final details of the residences or any other aspect of the Project. Developer reserves the right to make modifications, revisions and changes as permitted by applicable law and the governing purchase documents.

Depictions of furnishings, appliances, built-ins, counters, soffits, floor coverings, lighting, fixtures, finishes, decorations and other details are conceptual only. Items shown for display or illustration are not necessarily included with a residence and are included only to the extent expressly provided in an executed purchase agreement. Consult that agreement and the applicable offering documents to determine what is included.

Residence features, building amenities, services, manufacturers, brands and members of the design team are subject to change. Certain finishes, furnishings, amenities and services may be upgrades or extras requiring additional payment and may not be included with the purchase or ownership of a residence. Subject to applicable law and the governing purchase documents, Developer reserves the right to substitute proposed features, plans and specifications with items of similar or better value, as determined by Developer.

Dimensions, square footages and ceiling heights are approximate and may vary with actual construction. Floor plans and development plans are subject to change.

There are various recognized methods for calculating the square footage of a condominium unit (a “Unit”). The square footage and dimensions shown on Project floor plans are measured to the exterior boundaries of exterior walls and the centerline of interior demising walls. They may differ from measurements determined using the description and definition of a Unit in the condominium declaration, which generally includes the interior airspace between perimeter walls and excludes interior structural components. The area determined using the legally defined Unit boundaries will be established in the condominium declaration and/or map for the Project.

Room dimensions shown on floor plans are generally taken at the greatest points of each room as though the room were a perfect rectangle, without accounting for cutouts or irregularities. Accordingly, the actual room area will typically be smaller than the product obtained by multiplying the stated length by the stated width. Dimensions and square footage are approximate and may vary with actual construction. Depicted furnishings and other interior details are not necessarily included unless expressly identified as included in an executed purchase agreement.

Photographs on the Site may be stock photography or may have been taken off-site. They are intended to illustrate activities, concepts and the spirit of a proposed lifestyle, rather than necessarily depicting existing or proposed Project facilities, conditions or services.

Views will vary depending on the Unit purchased. No view is guaranteed. Any view from a Unit or other portion of the Project may be limited or eliminated by future development or other circumstances affecting the vicinity or sightlines of the Project.
Neighborhood attractions, restaurants, shopping, businesses and other venues referenced on the Site are off-site unless expressly identified otherwise and are not controlled by Developer. There is no guarantee that they will continue to exist or that their locations, operators, services or other characteristics will remain unchanged. References to third-party establishments do not imply their sponsorship or endorsement of the Project.

Project graphics, renderings, photographs, text and other materials are copyrighted works owned by Developer’s affiliates or their respective licensors or other rights holders and are used on the Site with authorization. Except as authorized by the applicable rights holder or permitted by law, reproduction, display, distribution or other dissemination is prohibited.

The Site may also contain trademarks, trade names, service marks, logos and other proprietary materials belonging to the Company, Developer, their affiliates, Four Seasons or other rights holders. Ownership remains with the respective rights holders. No ownership interest or license to use those materials is granted merely by visiting the Site, except for the limited website use expressly permitted below.

No real estate broker is authorized to make representations or other statements binding on Developer regarding the Project. Agreements with, deposits paid to or other arrangements made with a broker do not bind Developer unless expressly authorized by Developer in writing. Refer to Developer’s official Project materials, applicable offering documents and executed purchase agreement for information regarding the Project.

Purchasing real estate is a significant decision. Developer makes no representations concerning future profit, appreciation, income potential, tax advantages, depreciation, investment performance or other monetary or financial benefits from acquiring or owning a Unit.

Prices and availability are subject to change without notice, subject to an executed purchase agreement and applicable law. Advertised prices do not include optional features or premiums for upgraded Units unless expressly stated. Changes may occur before they are reflected on the Site or in other Project materials. Website Terms of Use
Please read these terms before using the Site. By using the Site, you agree to these terms to the extent enforceable under applicable law. If you do not agree, discontinue use of the Site. These terms govern website use and do not replace the documents governing a purchase of real estate.

You may use the Site and its materials for lawful, personal, noncommercial purposes. You may not reproduce, publish, distribute, commercially exploit or modify Site materials without permission from the applicable rights holder, except as permitted by law. Copyright, trademark and other proprietary notices must not be removed.

You must not use the Site to engage in unlawful activity, impersonate another person, submit misleading information, infringe another person’s rights, transmit malicious software, gain unauthorized access, interfere with security or operation, or collect information about other users without authorization. Automated scraping, harvesting, framing or mirroring of the Site is prohibited unless expressly authorized or permitted by applicable law.

We may update, restrict, suspend or discontinue Site features or access, subject to applicable law. We do not guarantee that the Site will always be available or free of interruptions, errors or harmful components. Changes to the Site do not modify an executed purchase agreement.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS INFORMATION AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, DEVELOPER AND THEIR RESPECTIVE AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS AND LICENSORS DISCLAIM LIABILITY FOR DAMAGES ARISING FROM THE USE OF, INABILITY TO USE OR RELIANCE ON THE SITE, INCLUDING INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES.

These exclusions do not apply to liability that cannot lawfully be excluded or limited, or to liability for fraud, gross negligence or willful misconduct. Nothing in these terms limits nonwaivable consumer rights or changes express obligations under an executed purchase agreement. Some jurisdictions do not permit certain exclusions or limitations, so portions of these provisions may not apply to you.

Links to independent third-party websites are provided for convenience. We do not control those websites, and a link does not imply endorsement. Their content, services and privacy practices are governed by their own terms and notices. These provisions do not exclude responsibility that applicable law requires us to retain.

Personal information submitted through the Site or in connection with an inquiry is governed by the Privacy Policy below. It is not treated as publicly available, assigned to us or available for unrestricted reproduction merely because it was submitted.
If you voluntarily submit nonconfidential, nonpersonal suggestions about the Site, you permit us to use those suggestions to operate or improve the Site without compensation. This permission does not apply to personal information, purchase documents, transaction instructions or information protected by an applicable confidentiality obligation.

Do not send payment instructions, bank account information, government identification numbers or other sensitive information through an ordinary website inquiry or unsecured email. Any transaction instructions should be provided only through a process expressly designated and verified for that purpose.

Submitting an inquiry does not reserve a Unit, establish a purchase agreement or create any entitlement to purchase. No employee, sales representative or broker may amend these website terms or a purchase agreement through an informal statement unless duly authorized to do so.

To the extent permitted by law, you agree to reimburse the Company, Developer and their respective affiliates for reasonable losses, liabilities and expenses arising from third-party claims caused by your unlawful use of the Site or your infringement of another person’s rights. This obligation does not apply to losses caused by the conduct of the party seeking reimbursement or to obligations that cannot lawfully be imposed on you.

We may revise these terms prospectively by posting an updated version and effective date. Additional notice or agreement will be provided or obtained where required by law. Changes will not retroactively modify an executed purchase agreement or eliminate rights that have already accrued.

If a provision is unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it on another occasion. Nothing in these website terms supersedes the dispute-resolution provisions of an executed purchase agreement.

Privacy Policy
This Privacy Policy describes how the Company handles personal information in connection with the Site, Project inquiries and related communications. It applies to information handled by the Company and service providers acting on its behalf. Independent third parties may also have their own privacy notices.

When you contact us or request Project information, we collect the information you choose to provide. Depending on your inquiry, this may include your name, email address, telephone number, mailing address, residence preferences, timing, broker affiliation and the contents of your communications. Please provide only information relevant to your request and do not include sensitive financial or identification information in an ordinary inquiry.

Depending on the features and technologies enabled on the Site, technical information may also be collected through your interaction with it. This may include an IP address, browser and device information, referral information, pages viewed, interaction times, online identifiers and approximate location derived from an IP address. Cookies, pixels and similar technologies may be involved in this collection.

We use personal information to respond to inquiries, provide requested materials, coordinate appointments and tours, communicate about the Project, maintain inquiry records, operate and improve the Site, protect against misuse, and comply with applicable legal obligations. Project-related marketing is subject to your preferences and any consent requirements imposed by law.

Visiting the Site or submitting an inquiry does not, by itself, constitute consent to automated marketing texts, prerecorded marketing calls or another activity for which separate consent is required. Any legally required consent must be obtained separately.

Personal information may be disclosed, as relevant to the purposes described in this policy, to authorized Project sales representatives and brokers; Developer and other Project-related entities involved in responding to your inquiry; service providers supporting hosting, communications, customer relationship management, analytics and other website or business functions; and professional advisers.

Disclosures to service providers are subject to applicable legal requirements concerning their use and protection of personal information. Information is not made publicly available merely because it is provided through an inquiry.
We may also disclose information when required by law or valid legal process, to establish or defend legal rights, to address fraud or security concerns, or in connection with a proposed or completed merger, acquisition, financing, reorganization or transfer of relevant business assets, subject to applicable law.

If analytics or advertising technologies are enabled, they may involve disclosure of online identifiers or website activity to technology providers. Depending on the arrangement and applicable law, certain disclosures may constitute a “sale,” “sharing” or processing for targeted advertising even when no money is exchanged. Rights concerning these activities are described below. This policy does not represent that every technology or disclosure described here is used in every interaction.

You may manage cookies through your browser settings and any privacy controls made available on the Site. Blocking or deleting cookies may affect functionality and does not necessarily stop every form of information collection or disclosure. Browser cookie controls are not a substitute for exercising any separate statutory opt-out right.

Depending on your location and applicable law, you may have rights to confirm whether personal information is processed; access, correct or delete it; obtain a portable copy; opt out of its sale, sharing, targeted advertising or certain profiling; limit certain uses of sensitive information; withdraw consent where processing relies on consent; and appeal a denied request. We will address requests within the time required by applicable law. If a request is denied, we will provide the explanation and appeal information required by law. Where an appeal right applies, you may submit an appeal through the same contact information and identify it as a privacy appeal. We will not unlawfully discriminate against you for exercising a privacy right.
You may opt out of promotional emails by following the unsubscribe instructions in those messages or by contacting us. You may also communicate preferences regarding other marketing channels. An opt-out from promotional communications does not necessarily prevent nonpromotional communications concerning your requests, an existing transaction or matters we are legally required to address.

The Site is intended for adults interested in the Project and is not directed to children. Individuals under 18 should not submit personal information through the Site. If you believe a child has provided personal information, contact us so that we can address it in accordance with applicable law.

Independent websites linked from the Site are governed by their own privacy practices. Review their notices before providing information directly to them.

We may update this Privacy Policy by posting a revised version and effective date. Material changes will be accompanied by any additional notice or consent required by applicable law. Continued use of the Site is not a substitute for consent where the law requires specific consent to a processing activity.
